1. Acceptance of Terms

Welcome to OurBigDay (“OBD”), owned and operated by LID Solution PVT LTD. These Terms & Conditions (“Terms”) govern your access to and use of our mobile applications, websites, and related services (“OBD Services”).

By accessing or using OBD Services, you agree to be bound by these Terms. If you do not agree, you must stop using the platform.

These Terms apply to all users, including event seekers, vendors, and visitors.

2. Description of Service

OBD is an event focused discovery and vendor connection platform for weddings, engagements, birthdays, anniversaries, corporate events, and other celebrations.

What We Provide

• A platform to browse and discover event and wedding vendors across various categories
• Tools to save vendors to a Finalized List
• Features to manage event planning preferences and budgets
• A marketplace for vendors to showcase their services and connect with potential clients
• Communication tools that allow users to express interest in vendors

What We Do NOT Provide

• Event services
• Booking management
• Vendor payment processing
• Guarantees of vendor performance
• Participation in contracts between users and vendors

OBD acts solely as an aggregator and lead generation tool. All agreements, payments, and transactions occur externally between users and vendors.

3. User Accounts

3.1 Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and up-to-date information
• Maintain the security of your password and login details
• Accept full responsibility for all activities under your account
• Notify OBD immediately of any unauthorized access or security breach

3.2 Account Eligibility

You must be at least 18 years old and legally able to enter into binding agreements.

3.3 Vendor Accounts

Vendors must provide valid business information and may be subject to verification. OBD may reject or suspend vendor accounts that:

• Provide false or misleading information
• Violate these Terms
• Engage in unethical or fraudulent practices

4. User Conduct

You agree not to use OBD Services to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property or privacy rights
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users or vendors
• Upload viruses, malware, or harmful code
• Attempt unauthorized access to the platform or other accounts
• Use automated tools to scrape, crawl, or extract data
• Interfere with platform operations or servers
• Impersonate any person or business
• Solicit personal information for unauthorized purposes

5. Vendor Responsibilities

Vendors agree to:

• Provide accurate and truthful business information
• Maintain required licenses, permits, and insurance
• Respond promptly and professionally to inquiries
• Honor commitments made to users
• Deliver services as described
• Resolve disputes directly with clients
• Comply with all applicable laws in Sri Lanka
• Avoid fraudulent, unethical, or misleading practices

OBD may remove vendors who violate these Terms.

6. Content and Intellectual Property

6.1 User & Vendor Content

You retain ownership of content you upload. By uploading content, you grant OBD a royalty free, non exclusive, worldwide license to use, display, and promote it, including with watermarking.

OBD may remove content that:

• Is unlawful, misleading, or offensive
• Violates intellectual property rights
• Promotes hate, harassment, or violence
• Violates any applicable law

6.2 OBD Content

All OBD-created content (logos, text, design, media) is protected by copyright and may not be reused without written permission.

7. Payments and Transactions

7.1 Service Fees

• OBD is free for event seekers
• Vendors may be charged registration, subscription, or promotional fees
• All fees paid to OBD are non refundable, unless otherwise stated in writing

7.2 Vendor Services

Payments for vendor services occur outside the OBD platform. OBD is not responsible for:

• Vendor pricing
• Vendor service quality
• Vendor cancellations
• Refunds or disputes
• Payment issues between users and vendors

7.3 Payment Gateway

Vendor subscription payments are processed through a third-party payment gateway. OBD does not store or process payment card details. The payment gateway handles all card information securely under standards.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

OBD Services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.

8.2 Vendor Services

OBD does not:

• Endorse vendors
• Guarantee vendor performance
• Verify vendor credentials beyond basic checks
• Participate in vendor contracts

Users must evaluate vendors independently.

8.3 Limitation of Liability

To the maximum extent permitted by law, OBD is not liable for:

• Loss of profits, data, or business opportunities
• Damages from use or inability to use the platform
• Vendor service failures or disputes
• Unauthorized access to accounts
• Errors, interruptions, or delays

OBD’s total liability is limited to the amount paid by you to OBD in the 6 months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless OBD, its directors, employees, and partners from any claims arising from:

• Your use of the platform
• Your violation of these Terms
• Your interactions with vendors
• Your uploaded content

10. Termination

10.1 By You

You may delete your account at any time.

10.2 By OBD

We may suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or harmful activities
• Fail to pay required fees
• Misrepresent business information

10.3 After Termination

Your access to OBD Services will cease immediately. Some information may be retained as required by law.

11. Dispute Resolution

11.1 User-Vendor Disputes

All agreements, payments, refunds, cancellations, and service-related issues between users and vendors occur outside the OBD platform. Users and vendors are solely responsible for resolving any disputes directly with each other. OBD is not a party to these agreements and has no obligation to mediate, enforce, or participate in dispute resolution. OBD may, at its discretion, assist with communication but does not guarantee involvement or outcomes.

11.2 Governing Law

These Terms are governed by the laws of Sri Lanka.

11.3 Jurisdiction

All disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts.

12. Changes to Terms

We may update these Terms at any time. Continued use of OBD Services after updates means you accept the revised Terms.

13. Miscellaneous

13.1 Entire Agreement

These Terms and our Privacy Policy form the entire agreement between you and OBD.

13.2 Severability

If any provision is unenforceable, the remaining provisions remain in effect.

13.3 Waiver

Failure to enforce any provision does not constitute a waiver.

13.4 Assignment

You may not transfer your account or rights under these Terms. OBD may assign these Terms without restriction.
