1. Acceptance of Terms

By accessing or using Our Big Day ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including couples planning their wedding, vendors providing services, and any other visitors to our platform.

2. Description of Service

Our Big Day is a wedding planning platform that connects couples with wedding vendors and service providers in Sri Lanka. We provide:

• A platform to browse and discover wedding vendors across various categories
• Tools to communicate with vendors and request quotes
• Features to manage wedding planning tasks and preferences
• A marketplace for vendors to showcase their services and connect with potential clients

We act as an intermediary platform and do not provide wedding services directly. All services are provided by independent third-party vendors.

3. User Accounts

3.1 Account Registration

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.3 Vendor Accounts

Vendors must provide valid business information and may be subject to verification. We reserve the right to reject or suspend vendor accounts that do not meet our standards or violate these Terms.

4. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems to scrape, crawl, or access the Service without permission
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Solicit personal information from other users for unauthorized purposes

5. Vendor Responsibilities

Vendors using our platform agree to:

• Provide accurate and truthful information about their business and services
• Maintain all necessary licenses, permits, and insurance required to operate their business
• Respond promptly and professionally to inquiries from couples
• Honor any quotes, agreements, or commitments made through the platform
• Deliver services as described and agreed upon
• Comply with all applicable laws and regulations in Sri Lanka
• Resolve disputes with clients directly and in good faith

We reserve the right to remove vendors who violate these Terms or engage in fraudulent or unethical practices.

6. Content and Intellectual Property

6.1 User Content

You retain ownership of any content you post, upload, or share on the Service ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content for the purpose of operating and promoting the Service.

6.2 Our Content

All content on the Service, including text, graphics, logos, images, and software, is owned by Our Big Day or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6.3 Prohibited Content

You may not post content that:

• Is illegal, harmful, or violates any laws
• Infringes on intellectual property rights
• Contains personal information of others without consent
• Is defamatory, obscene, or offensive
• Contains spam, advertising, or promotional materials without permission

7. Payments and Transactions

7.1 Service Fees

Some features of the Service may require payment. We reserve the right to change our pricing at any time. All fees are in Sri Lankan Rupees (LKR) unless otherwise stated.

7.2 Vendor Services

Payments for vendor services are made directly between you and the vendor. We are not responsible for:

• The quality, safety, or legality of vendor services
• The accuracy of vendor listings or quotes
• The completion of transactions between users and vendors
• Disputes arising from vendor services

7.3 Refunds

Refund policies are determined by individual vendors. We do not guarantee refunds for vendor services. Any disputes regarding payments should be resolved directly with the vendor.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

8.2 Vendor Services

We do not endorse, guarantee, or assume responsibility for any vendor services, information, or advice provided through the platform. You acknowledge that:

• We are not a party to any agreements between you and vendors
• You are solely responsible for evaluating vendors and their services
• We are not liable for any damages arising from vendor services
• You should verify vendor credentials, licenses, and insurance independently

8.3 Limitation of Liability

To the maximum extent permitted by law, Our Big Day shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Damages resulting from use or inability to use the Service
• Damages arising from vendor services or interactions with vendors
• Security breaches or unauthorized access to your account

9. Indemnification

You agree to indemnify, defend, and hold harmless Our Big Day and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another user
• Your User Content
• Your interactions with vendors or other users

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

10.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms or our policies
• Engage in fraudulent, illegal, or harmful activities
• Infringe upon the rights of others
• Fail to pay required fees
• For any other reason we deem necessary to protect the Service or users

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content, though some information may be retained as required by law.

11. Dispute Resolution

11.1 User-Vendor Disputes

Disputes between users and vendors should be resolved directly between the parties. We may provide assistance in facilitating communication but are not obligated to mediate or resolve disputes.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

11.3 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website
• Sending email notifications to registered users
• Displaying a notice in the app

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Our Big Day regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

13.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not assign or transfer your account or these Terms without our prior written consent. We may assign these Terms without restriction.
